The intent of the listing process is to ensure providers meet all Early Learning Divisions, Office of Child Care (OCC) licensing requirements, meet all Department of Human Services (DHS) pre-service program requirements, health and safety standards and pass a background check to be eligible for payment. This means the provider completes a Family Child Care Overview session, meets training requirements, passes criminal and child protective services records checks, agrees to meet health and safety standards and passes a health and safety review by OCC. (i) Requirements, policies, and procedures to require and conduct criminal background checks for child care staff members (including prospective child care staff members) of all licensed, regulated, or registered child care providers and all child care providers eligible to deliver services for which assistance is provided under this part as described in paragraph (a)(2) of this section; Beginning this month, child care providers in Kansas applying for or renewing a license are legally required to submit to a comprehensive background check, including fingerprints, for each individual residing, working or regularly volunteering in a licensed child care home, daycare center or school-age program.

In addition to fingerprint background check, child care providers will need to put staff members through federal-level criminal history searches The MyNDNow article notes these checks could include in-state Bureau of Criminal Investigation (BCI) searches, Federal Bureau of Investigation (FBI) database searches, or both. RICHMOND, Va. (WSET) - A proposed law could change the way child care providers operate, requiring criminal history background checks. As part of the new law, beginning in July of 2017, all licensed child care providers (and unlicensed non-relative providers who care for children receiving a subsidy) will be required to have a fingerprint-based background check.

The state Department of Human Services says a one-year waiver will allow new employees hired by licensed and regulated child care providers in North Dakota to begin working under direct supervision before their background checks are complete. Department of Health and Environment Child Care Licensing staff is working closely with the Kansas Department of Health and Environment and local law enforcement agencies to make the process of completing the background check paperwork and fingerprinting smooth and efficient for providers. Over the next several years, new federal law will require states to conduct criminal background checks on all child care employees that work at a licensed, license-exempt, regulated, and registered child care provider. To be paid by the State of Illinois to provide child care services, all providers who are exempt from licensing are required to have all required checks in the background check process. The State of South Carolina has contracted with MorphoTrust to provide electronic fingerprinting services for child care providers who require a state (SLED) and federal (FBI) fingerprint-based criminal history background check.

Federal law requires all states to implement state and federal criminal background checks that include fingerprints for child care providers. Fortunately, with the reauthorization of the Child Care and Development Block Grant in 2014, states now require comprehensive background checks, including fingerprint checks, for all child care providers caring for unrelated children and for all providers receiving federal subsidies. Additionally, home-based child care providers legally exempt from child care licensing may be eligible to accept Colorado Child Care Assistance Program (CCCAP) child care subsidy payments by participating in a background check and yearly health and safety inspections.

A House version and Senate version would require anyone serving a child care provider to undergo a fingerprint-based national criminal history background check, including employees and volunteers with any licensed family day system, child day center, registered family day home, as well as any adult living in the home. This proposed rule makes changes to CCDF regulatory provisions in order to strengthen health and safety requirements for child care providers, reflect current State and local practices to improve the quality of child care, infuse new accountability for Federal tax dollars, and leverage the latest knowledge and research in the field of early care and education to better serve low-income children and families.
